1. Access to services and products
● Access to the services and/or products is allowed to any customer who owns or creates an account on the website www.madalinafit.com.
● In order to be allowed access to the services and/or products, the member will have to accept the terms and conditions governing the legal relationship between MADALINAFIT S.R.L. and the customer.
● MADALINAFIT S.R.L. reserves the right to restrict or exclude the customer’s access to the services and/or products, and/or to some of the accepted payment methods, and to delete or restrict the customer’s account, within the limits of the law, if it considers that, on the basis of the customer’s conduct or activity on the website www.madalinafit.com, access and the existence of the customer’s account could, in any way, prejudice MADALINAFIT S.R.L.. The customer may, in writing, contact the customer relations department of MADALINAFIT S.R.L. to be informed of the reasons for the application of these measures.
● Each customer can have only one account. It is forbidden to share an account between multiple customers.
● Live sessions will take place through Zoom platform or WhatsApp, according to the client’s preference.
● Live sessions will start in 2-7 working days from the payment confirmation, as per the customer’s availability.
● The following packages will be delivered automatically via email after the payment confirmation:

● www.madalinafit.com may publish information about the products and/or promotions practiced by MADALINAFIT S.R.L. on the website;
● www.madalinafit.com may limit the ability of some customers to purchase products and/or services available on the site at any given time, under the conditions of Article 7.1.
● All tariffs on the products and services presented on the website are expressed in euro (EUR).
● All information used to describe the products and services available on the website www.madalinafit.com (static/dynamic images/multimedia presentations/etc.) do not represent a contractual obligation on the part of MADALINAFIT S.R.L., and that information is used exclusively for presentation purposes.
● In the description of the products and services, MADALINAFIT S.R.L. reserves the right to use other accessories that may not be included in the costs of those products/services presented.
3. Orders
● The customer can place orders for products/services sold at any given time on the website www.madalinafit.com, by adding the desired product(s)/service(s) to the shopping cart, and to complete the order by making the payment via one of the expressly indicated methods. Once added to the shopping cart, a product is available for purchase as far as it exists in stock. Adding a product to your shopping cart, in the absence of the completion of your order, does not result in automatic booking of that product.
● By completing the order, the customer agrees that all the data provided by the customer, necessary for the purchase process, is correct, complete and true at the time of placing the order.
● By completing the order, the customer agrees that www.madalinafit.com may contact him, by any means available/agreed by www.madalinafit.com and provided for in this Sales Policy, in any situation where contact is required.
● www.madalinafit.com may unilaterally cancel the customer’s order following prior notice to the customer, without any subsequent obligation of either party to the other, or without any party being able to claim damages from the other in the following cases:
● In case of refusal by the issuing bank of the customer’s card of the payment if it was made online;
● Invalidation of the transaction by the card processor approved by the www.madalinafit.com in case of online payment;
● the data provided by the customer on the website is incomplete or incorrect;
● the customer’s activity on the website may and/or cause damage of any kind, or in any way prejudice the
www.madalinafit.com or MADALINAFIT S.R.L.;
● a failure to carry out more than one consecutive delivery attempt;
● The customer does not have the right to change the contents of an order after it has been shipped.
● Details of the delivery of products including but not limited to the time required for delivery do not constitute a contractual obligation on the part of the www.madalinafit.com, without any party being able to claim damages from the other, if any damages arise from a delayed delivery.
4. Limitation of liability
www.madalinafit.com may not be held liable in any way to any customer who uses the website or content, other than within the limits of the provisions constituting terms and conditions.
5. Final provisions
● MADALINAFIT S.R.L. reserves the right to make any changes to these provisions, as well as any changes to its website/structure and any content.
● MADALINAFIT S.R.L. reserves the right to place advertising banners of any kind and/or links on any page of the website, in compliance with applicable law.
Policy on right of withdrawal for distance and off-premises contracts
(“Policy”)
This Policy summarises some of your key rights and provides information on cancellation and returns. It is not intended to replace the Terms and Conditions contained in our website, which you should read carefully before you buy any digital content from MADALINAFIT S.R.L. („MADALINAFIT S.R.L.”).
For the purpose of this Policy,
• We’, ‘us’ or ‘our’ means MADALINAFIT S.R.L., and
• ‘You’ or ‘your’ means the person buying digital content, services, goods from us.
A. Can I withdraw from the contract and return the products I have ordered?
1. You can cancel your order within 14 days starting with the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the goods without giving a reason and get a full refund, only in what concerns the following products you may purchase from MADALINAFIT S.R.L.:
a. Fitness Accessories
b. Clothing
2. The law in force gives any citizen the right to withdraw from a distance contract within 14 days of its conclusion, without justification of the decision and without any cost other than those stipulated by law. However, please note that these provisions do not apply to digital content which is not supplied on a tangible medium, or clearly customized for the Customer, such as the following services offered by MADALINAFIT S.R.L.:

For this purpose, when you place an order for digital content, you will be asked to tick a box to confirm that you acknowledge that this means you lose your right to withdraw from the contract.
This means that you do not have the right to withdraw from the contract once you have purchased the digital content and you are not entitled to a refund unless the digital content is faulty.
What does „faulty” mean?
The digital content that we supply to you must be as described, fit for purpose and of satisfactory quality. If your digital content is faulty, you are entitled to a repair or a replacement.
If the fault can’t be fixed, or if it hasn’t been fixed within a reasonable time and without significant inconvenience, you can get some or all of your money back.
If you can show the fault has damaged your device and we haven’t used reasonable care and skill, you may be entitled to a repair or compensation.
You must tell us about any fault or damage as soon as reasonably possible by contacting us using the contact details set out in How can I contact you? below.
B. How can I cancel my order?
If you want to cancel your order, you must let us know. You can do this by contacting us by email, post or telephone using the contact details provided in How can I contact you? Below.
To meet the cancellation deadline, it is sufficient for you to send your cancellation request before the 14-day cancellation period has expired.
C. When will you issue the refund?
We will refund all payments received from you within 14 days of your cancellation request.
D. How will you refund me?
We will issue the refund using the same payment method you used when you placed your order, unless you have expressly agreed otherwise.
In any case, you won’t incur any fees as a result of the refund.

F. Effects of withdrawal
1. If you withdraw from the contract in accordance with Art. A.1, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
2. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
3. If you have received goods:
a. you shall send back the goods or hand them over to us on the address Bucharest – Sector 4, Bucharest – Sector 4, Soseaua Oltenitei 81, bl. 6, sc. 2, et. 7, ap. 66, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from the contract to us. The deadline is met if you send back the goods before the period of 14 days has expired;
